FAIR LABOR STANDARDS ACT OVERTIME RULES UPDATE

Jenny will give us an overview of recent litigation related to the Fair Labor Standards Act overtime rules, including a review of the Encino Motor Cars case where the Supreme Court of the United States applied a more broad reading of an FLSA exemption rather than previously applied narrow construction. The Wage and Hour Division has recently settled investigations with roofing companies, restaurants, and multiple healthcare entities for over $60,000 related to overtime violations. The presentation will also cover the Department of Labor’s new compliance assistance tools that launched in June. We will also review recent guidance from the Department of Labor on several important topics surrounding payment of overtime, classification of employees, and when bonuses are required to be calculated at the regular rate.

    Jenny Holt-Teeter, J.D. is a Director and Shareholder with Gill, Ragon, Owen, P.A..  She joined the Arkansas Bar in 2007. She received an undergraduate degree from Hendrix College in Conway, Arkansas where she graduated cum laude, with Distinction, and a law degree from University of Arkansas at Little Rock School of Law. Her practice focuses on matters involving general employment law, regulatory compliance and general corporate and nonprofit law. She assists employers with general employment law compliance issues and healthcare providers and long term care facilities with regulatory registration and compliance. She also provides general guidance and documentation to business entities and nonprofit corporations. She is the Chair of the firm’s Health Law Group and a member of the firm’s Employment Practices Group and Privacy Law Group. Jenny enjoys working with nonprofit and educational organizations in her free time. She serves as Chair of the UAMS College of Health Professions Advisory Board. Jenny is an active member of HRMA.
